  9. In this episode, consultant David Fisher gives you a chance to understand OSHA and keep you compliant. This is a must listen episode. The information could save your business. Regarding workplace safety and HR compliance, 85 - 90% are not compliant across America. To be non-compliant could cost your business. OSHA will interview your employees. Are you inspecting your lifts yearly? Does your team have access to SDS sheets (Safety Data Sheets). Are you giving all your employees access to your safety program? OSHA is ramping up stricter enforcement procedures. Invest in an annual walk of your shop from an OSHA consultant and get the accountability you need to prevent huge fines. Dave's previous episodes HERE Show Notes OSHA - will now interview your employees while inspecting your job site Ignorance is not an excuse anymore OSHA has determined that they want safety in the workplace. Compliance is like a picture painted by numbers. The more numbers you have filled in, the better off you're gonna be. OSHA is looking for, among others is your safety program, safety training, documentation, workers' compensation You've got 72 hours to a week at the most to get it back to them with your reply. After they get your reply, they're gonna review it, and then they're gonna assess the fines and fine you accordingly. No matter what state you do business in, you must meet the basic OSHA standards. Every year, you must have your lifts certified/inspected. You can certify them yourself if you installed them. The company that sold them can certify them. But if you install them, the state feels you have the wherewithal to inspect them and certify them. Be careful. There is no easy button for safety or HR compliance. The one thing you do have to be aware of is that if you name a safety officer in your business, they're gonna be tied into any potential lawsuit that arises out of a safety act or an accident in the workplace. OSHA knows that we, as a group of consultants, have more authority and more power over employers than they do When a company has paid money for a safety consultant, they know that the shop has an accountability partner, If you're gonna get with an HR services company, make sure they're working with actual attorneys. Make sure that these attorneys are gonna be there for your clients. You can have a perfectly legal employee handbook that covers the policies adequately. But you may not be able to take that employee handbook into court because when you go to court, there are certain things that the judge is gonna look at to make sure is in certain places of your employee handbook. If it's not in those places, you're gonna have two strikes against you in the eyes of the judge before you even start One is your at-will status between page one and page three Number two is your sexual harassment policy. Is it between pages three and page five? Does your sexual harassment policy include bullying in the workplace and all the other things that have now been dovetailed into that policy? You need to understand your policy and how a termination, not done correctly, can hurt a suit from a former employee. This three strikes you're out is a joke. There is no effort to rehabilitate the employee in most companies. Some companies are very progressive, and that's a good thing. Create a very positive workplace culture. Never make a decision in a ‘valley,’ aka emotional. You can’t sell sweat equity. Your business is for sale every day- every decision affects your business. Your goal as an owner is to work your way out of the company, not get stuck in the job. What is your identity? What is your identity post ownership? To maximize your selling price, you need two things: Sustained profit (typically an 8 to 10 year runway) and a business that will operate without you. Staff is aware and supportive of the owner's succession desires and planning- everyone should be involved respectfully. Your team wants certainty. Create a haven where they can feel safe, do their job, be challenged, be a part of something, and have fun. Do you have the right people and team in place? What is the market for selling your business? 80% of small businesses do not survive the departure of the current owner. Hiring is like fishing- know what fish, what bait will attract the fish, and where is that fish. Consider ‘ownership potential’ when hiring quality staff. Show a future no one else does. What does training do? Improve skills and communication. The more we communicate, the less friction there is in the business. Valuate your business- the stuff inside your building, cash flow, multiple average 2.5. Take your assets, 25 cents on the dollar plus inventory as part 1, then your cash flow multiplied by 2.5 to get a ballpark number. 6 Metric Multiple- how independent is the business from the owner? Customer facing employees tenure, production staff tenure, stability, revenue trends, gross margin trends and SOP for business. Multiplier- confidence factor. How confident will the new owner feel when the old owner is out? Financial records are pure, accurate, and updated- get your balance sheet right, and don’t hide cash from the business. Sue Dickson created an internship program called 'Give Me 10' that provides 10 hours at a local shop spread out over 5 days. It allows both the shop owner and student to see if the automotive industry is the right career path. This program currently serves 75 students and has collected over 458K in grants. Paid everybody for the day off for the funeral and for the day that they closed. Promoted within and already had potential employees in the wings- always be recruiting. A new hire must read 2 books (Customer Service Revolution- John DiJulius and Unstoppable- Dave Anderson) and will spend 30 days in training before they're really set loose. Multiple different layers of managers- district managers, store level managers, shop foreman, and a lead tech that oversees all the shop foremen. Don't just build better team members, but rather build better people. Focus on hospitality training. Rip off and duplicate- nothing's new, you just have to make it yours. FORD - family, occupation, recreation, and dreams. Acquisitions- owners retiring, consolidation. What is your exit strategy? Pay attention to Opportunities- little things that matter. Do research and homework on the company before investing in or buying them Advice if you want to grow to multi shops- have a phenomenal team before starting a new shop, people who want to grow with you. Share your goals with your team. Be transparent. Have your finances in order. Solid systems and processes. Keep the career path aligned so they're growing and seeing the value and the work they're putting in. Connect, build a relationship and have a coach. You learn from every interaction, every moment of everything you do if you allow yourself to be able to be open to it.   24. There's an art to giving and receiving critical feedback properly. Join Dr. Dave Weiman as he dives into the psychological background of what happens when people feel criticized. He also explains common mistakes and practical tools to apply for an effective and efficient conversation. Dr. David Weiman is the president of Weiman Consulting, a leadership consulting firm in Philadelphia PA. Listen to David’s previous episodes HERE Show Notes Common mistakes managers make- waiting too long to give the feedback, if you're letting things fester and stew, by the time you give the feedback, you're really angry, talking about things you didn't directly observe, loading up with several complaints at the same time, and talking too long at the beginning of the conversation Give positive feedback when it's fresh Are people conditioned and associate that good news is always followed by bad news with the 'sandwich technique?' Make it a conversation, not an event. What happens when people feel criticized? Stop listening as they plan how to defend themselves (as defensiveness goes up, listening goes down) Feel resentful. Can wonder why this wasn’t brought up before. Get angry in response. How to give effective critical feedback- mindset, be curious about what the other person’s response may be. Keep your “opening” short, no more than 3 sentences and no more than 10 words per sentence. Use the Situation-Behavior-Impact model from the Center for Creative Leadership: Situation- generally what was going on, “When you were taking the keys from that customer and they said they looked up the problem on google …” Behavior- “I noticed you rolled your eyes.” Impact- the customer said “I saw that!” asked to talk to the manager Interestingly, in studies of body language, we're the least aware of what's going on with our own face because we can't see it, the other person can. A lot of time when we're giving feedback, we're not putting ourselves in the shoes of the person who's receiving it.
